Part 1: Terms of Use

These terms are an agreement between you and Zest Mavericks ("we", "us", "our") about your use of Mark PDF (the "App"). Please read them before using the App. By downloading, installing or using the App you agree to them. If you do not agree, do not use the App.

1. The licence we give you

We grant you a personal, revocable, non-exclusive, non-transferable, limited licence to install and use the App on Apple branded devices that you own or control, for your own purposes or the internal purposes of your business, in line with these terms and the Usage Rules in Apple's App Store Terms of Service. Using the App at work or on work documents is fine. Reselling it, or offering it as a service to other people, is not.

2. What the App does

Mark PDF is a document tool. Depending on your plan it can:

• Open, read and annotate PDFs, including highlights, comments and drawing
• Scan documents with your camera, including auto capture and cropping
• Merge, split, reorder and delete pages
• Extract images from a PDF and compress file size
• Fill and sign documents
• Protect a document with a password, and remove that protection
• Add watermarks
• Convert a web page to a PDF from a URL you provide
• Summarise a document using a large language model
• Edit text, images and annotations in a PDF

Features change as the App is updated. Some features need an active subscription. We may add, change or withdraw features, and we will not remove a feature you have paid for during a billing period without offering you a way out.

3. Your documents stay yours

You keep every right you already have in the documents, scans, signatures and other content you use with the App ("Your Content"). We do not claim ownership of it and we do not acquire a licence to publish, display, distribute or otherwise exploit it.

You give us permission to process Your Content only to the extent needed to deliver the feature you asked for, at the moment you ask for it. In practice that means sending a document's text to our AI provider when you tap summarise. That permission ends when the operation ends.

You are responsible for having the right to use the documents you put into the App, and for not using it on content that is unlawful or that you are not permitted to copy or modify.

4. AI summaries

Summarisation is a Pro feature. When you use it, the text of the document you selected is sent from your device to an AI provider, which returns a summary. Details of that provider and its retention are in the privacy policy below.

Summaries are generated by a language model and can be incomplete or wrong. Treat a summary as a starting point, never as a substitute for reading the document. Do not rely on one for legal, medical, financial, safety or other consequential decisions. We are not responsible for what a summary says or for anything you do on the strength of it.

Please do not use the feature on documents you are contractually or legally barred from disclosing to a third party processor.

5. Converting web pages

When you convert a web page, the App fetches that page from your device using the address you supply. You are responsible for the addresses you enter, for respecting the terms and copyright of the sites you convert, and for only converting pages you are allowed to access.

6. Document passwords

When you lock a document, the password protects that file. We never receive it and we do not keep a copy, an escrow or a recovery key. If you lose the password, we cannot open the document for you and neither can anyone else. Keep your own record of it, and keep your own backups of important files.

7. Things you may not do

You agree not to, and not to let anyone else:

• Sell, rent, lease, sublicense, distribute or host the App, or make it available to a third party as a service.
• Copy or use the App other than as the licence above allows.
• Modify, disassemble, decrypt, decompile or reverse engineer any part of the App, except to the extent that applicable law expressly permits it despite this restriction.
• Remove, alter or obscure any copyright, trademark or other proprietary notice.
• Use the App to break the law, to infringe someone's rights, or to strip protection from a document you are not authorised to open.
• Interfere with the App's security features, or use automated means to hammer any service the App relies on.

8. Subscriptions, trials and billing

Mark PDF is free to download and includes a set of free features. Mark PDF PRO is sold as an auto renewing subscription through the App Store, currently on weekly, monthly and yearly terms.

• The price, currency and billing period for your region are shown in the App before you confirm. Prices differ by country and can change; any change is shown to you before it takes effect.
• Payment is charged to your Apple Account when you confirm the purchase.
• A free trial is offered on the monthly and yearly plans. Unless you cancel at least 24 hours before the trial ends, it converts into a paid subscription at the price shown, and you are charged then.
• Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before that period ends.
• You manage and cancel subscriptions in your Apple Account settings, not in the App. Deleting the App does not cancel a subscription.
• Any unused part of a free trial is forfeited if you buy a subscription before the trial ends.

Refunds. Apple, not us, processes payments and handles refunds for App Store purchases, under Apple's Media Services Terms and Conditions. Request one through Apple. Nothing here limits any cancellation, withdrawal or refund right you have under the consumer law of your country, including the statutory right of withdrawal available to consumers in the EU and the UK.

9. Our intellectual property

The App itself, its code, design, name and logo belong to Zest Mavericks or our licensors. These terms give you a licence to use the App and nothing more. They do not give you any right to our trademarks, logos, domain names or brand features.

10. Apple's role

This agreement is between you and us. Apple is not a party to it. You also agree that:

• Apple has no obligation to provide maintenance or support for the App. We are solely responsible for support. Write to zestmavericks@gmail.com.
• If the App fails to conform to any applicable warranty, you may tell Apple, and Apple may refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation for the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are ours to handle.
• We, not Apple, are responsible for addressing any claim about the App, including product liability claims, any claim that the App fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or privacy law.
• We, not Apple, are responsible for investigating and resolving any third party claim that the App infringes that party's intellectual property rights.
• You represent that you are not located in a country subject to a United States government embargo or designated as a terrorist supporting country, and that you are not on any United States government list of prohibited or restricted parties.
• Apple and its subsidiaries are third party beneficiaries of these terms and may enforce them against you.

11. Updates

We release updates through the App Store. Some are needed for the App to keep working, and older versions may stop being supported. Your device may install updates automatically depending on your settings.

12. Warranties

The App is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the App will be uninterrupted, error free, or that any output, including a summary, will be accurate.

Some countries do not allow the exclusion of certain warranties. If you are a consumer, you keep every right your local law gives you, and nothing here removes it.

13. Limits on liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost data, lost goodwill or other intangible losses arising out of your use of the App. Our total liability for any claim relating to the App is limited to the amount you paid us for it in the twelve months before the claim, or the equivalent of ten United States dollars if you paid nothing.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited under applicable law.

14. Ending this agreement

You may end it at any time by deleting the App, though you still need to cancel any subscription through Apple. Your rights under this licence end automatically if you break its terms. We may suspend or end your access if you use the App unlawfully or in a way that harms other users or our services, and we will tell you why unless the law prevents it.

15. Governing law

These terms are governed by the laws of India, without regard to conflict of law rules. The courts at Bangalore, India have exclusive jurisdiction, except that if you are a consumer you may also bring proceedings in the courts of the country where you live, and you keep the protection of any mandatory consumer law there.

16. Changes to these terms

We may update these terms. We will change the date at the top and post the new version here. If a change materially reduces your rights, we will give reasonable notice in the App before it takes effect. Continuing to use the App after that means you accept the new terms.

Part 2: Privacy Policy

This policy explains what Mark PDF does with information, and what it deliberately does not do. Zest Mavericks is the controller of the personal data described here, and the data fiduciary for the purposes of India's Digital Personal Data Protection Act 2023.

1. Your documents

Documents you open, scans you take, signatures you draw, watermarks you add and passwords you set are stored on your device and in whatever storage you choose through the iOS Files system, such as iCloud Drive if you save there. We do not run an account system, we have no server that holds your files, and we cannot see them.

The one exception is AI summarisation, described next. Everything else, including scanning, merging, splitting, compressing, extracting images, watermarking, signing and password protection, happens on your device.

2. AI summarisation

When you ask for a summary, the text of the document you selected leaves your device and is sent to Apple Inc., which generates the summary and returns it. This happens only when you start it, only for the document you chose, and only while you have an active Pro subscription.

That text is not used to train any model, and the provider retains it only for 30 Days. We do not store the document, the summary, or a log of the content on our own systems.

A document can contain personal or confidential information, so treat this feature as a decision to share that document with a third party processor, and use your judgement about which documents you summarise.

3. Converting a web page

The App requests the page directly from your device using the address you type. The site you visit will see that request in the same way it would see a browser visit. We do not proxy it and we do not keep a record of the addresses you convert.

4. Diagnostics and analytics

We use Google Firebase to collect crash reports, performance data and other diagnostics when the App misbehaves. This can include device model and manufacturer, operating system version, app version, general device settings, and information about which screens and features were in use around the time of a problem.

This data is not linked to your identity and is not used to track you across other companies' apps or websites. We use it to find bugs, to see whether new features work, and to improve the App. It never includes the contents of your documents.

Google acts as our processor for this and its own privacy terms apply to the data it handles on our behalf.

5. Purchases

Apple handles every payment. We never see or store your card details, billing address or Apple Account credentials. We receive only what we need to unlock Pro features, which is whether a valid subscription exists on the device, together with anonymous aggregate sales reports from App Store Connect.

6. Permissions the App asks for

• Camera: only when you open the scanner, and only to capture the pages you are scanning. Images go straight into your document on the device.
• Photos and Files: only when you choose to import or export something, and only for the items you pick.

You can withdraw any of these in the iOS Settings app at any time. Some features stop working without them.

7. Why we are allowed to process this

If you are in the EU, the UK or another region with similar rules, our legal bases are: performance of our contract with you, for processing that is needed to deliver a feature you asked for, such as producing a summary; our legitimate interest in a stable, working product, for crash and performance diagnostics; and your consent, for device permissions such as the camera, which you can withdraw at any time.

8. Who we share with

We do not sell your personal information, we do not share it for cross context behavioural advertising, and we run no advertising in the App. We share data only with:

• Our AI provider, and only the text of a document you chose to summarise, at the moment you ask.
• Google Firebase, for crash and performance diagnostics.
• Apple, for app distribution and payments.
• Authorities, where we are legally required to disclose something, or where it is necessary to establish or defend a legal claim. We will tell you unless the law forbids it.

9. How long we keep things

Diagnostic data is retained for as long as it is useful for debugging and then deleted on Firebase's standard schedule. Document text sent for summarisation is retained only for the period stated in section 2. Emails you send us are kept while we deal with your query and for a reasonable period afterwards.

10. International transfers

We are based in India, and our providers may process data in other countries, including the United States and the European Union. Where personal data is transferred out of the EEA or the UK, it is covered by the appropriate safeguards our providers put in place, such as the European Commission's standard contractual clauses.

11. Your rights

Depending on where you live you may have the right to access a copy of your personal data, correct it, delete it, restrict or object to processing, ask for it in a portable format, withdraw consent, and complain to a regulator. Users in India have rights of access, correction, erasure, grievance redressal and nomination under the DPDP Act. Users in California may ask what we collect and request deletion, and will not be treated differently for asking.

Because we hold almost nothing that identifies you, there is often little for us to return. Write to zestmavericks@gmail.com and we will answer within 30 days.

12. Complaints and grievances

If something we have done with your data bothers you, tell us first and we will try to fix it. Our grievance officer for the purposes of Indian law is Aakash, reachable at zestmavericks@gmail.com. You may also complain to your local data protection authority, or to the Data Protection Board of India.

13. Children

Mark PDF is a document tool for general use and is not directed at children. We do not knowingly collect personal data from children under 13, or under the age at which parental consent is required where you live, which is 16 in parts of the EU and 18 in India. If you believe a child has provided us with personal data, write to us and we will delete it.

14. Security

Everything the App sends over the network uses HTTPS. Documents stay in your device's own storage and are protected by iOS file protection and your device passcode. We keep the amount of data we hold deliberately small, which is the most reliable security measure available to us. No system is perfect, and no transmission over the internet can be guaranteed against interception.

15. Do Not Track

There is no finalised standard for Do Not Track signals, so we do not respond to them. We do not track you across other companies' apps or sites in any case.

16. This website

zestmavericks.com sets no cookies and runs no analytics or advertising scripts. If you use the contact form, the subject, name, email and message you type are sent to a Google Apps Script endpoint and stored in a Google Sheet we control, so that we can reply. We keep those messages for as long as we need them and delete them on request. Our web host may keep standard server logs, including IP addresses, for a short period.

17. Changes to this policy

We will post any change here and update the date at the top. If a change is significant, for example a new category of data or a new processor, we will say so in the App. This version is effective from 10 August 2026.
